We ask that you please take the time to read our terms of service thoroughly so that you know in detail as to what our guidelines are when utilizing our services at MisBEEhaven Designs.

Consultation
We at MisBEEhaven Designs, are more than happy to take the time to go over what we feel would be the best design for your website.  We highly recommend that this is done so that it is clear to both parties as to what is to be expected for the outcome of the design.  The initial Consultation is free of charge.

Estimate
After our consultation with you, we will give you, to the best of our knowledge, an estimate as to how much the web design will cost.  Please note; that this is done as an “estimate” and we cannot guarantee that this will be the final billable amount.  In some cases the design may take more work than originally expected.  Should this be the case, the final bill will change.  We do our very best to stay as close to the estimate price as we can.

Fees
It is required that ½ (50%) of the total estimate be paid BEFORE the work is started.  Once the web design is finished and complete the remaining billable amount will be due before transferring of the files begin.  Should you not pay the remaining amount due within 30 days; you shall forfeit the original deposit and the work then becomes MisBEEhaven Designs property.  Additional fees can occur should you need any specific graphics or software purchased to complete your design.

Refunds
MisBEEhaven Designs has a No Refund Policy.  Please remember; it is our time that you are paying for as well as the design.

Search Engines
MisBEEhaven Designs will insert all keywords and descriptions on the pages of your website when it is initially designed.  However, it is your responsibility to submit your website to search engines, or hire someone who will do so.  We will not be held responsible for any websites not receiving traffic, or for those who generate no sales.  We design; not submit.

Modifications/Changes
Once the initial web design is complete; should the web site owner decide that they would like changes made to the site, this will require additional fees.  Before any changes will be made; we again will go through a consultation, the estimate, and 50% of the fees will be required before work will begin. We will not be held responsible for any modifications or changes and/or errors made to the website or the template created that are not of our own. Should you decide to have another party work on your website and as stated above, errors occur, we at MisBEEhaven Designs will repair the errors for you; however additional fees will apply before the work is started.  All credits of work done by MisBEEhaven Designs plus credits of graphics done by a third party must stay intact on the site.

Updates
MisBEEhaven Designs is more than happy to do monthly changes and updates to your website.  Please see our packages for a price guide.

Ownership
Once design is complete and payment is made; ownership of the site and all rights shall be owned by our client.  All trademarks & copyrights remain property of their respective owners ie: graphics made by a third party.

Uses
MisBEEhaven Designs has the right to share your website and use a screenshot of your site in our portfolio.

Warranties
Should the client have anyone else besides MisBEEhaven Designs do any work, including uploading any graphics, changing links etc. to the site, we will not be responsible for any errors that occur.  Should anything need to be fixed, certain fees will apply.

Trademarks & Copyrights
Should the Client provide MisBEEhaven Designs with any images, photos, or content, it is the client’s responsibility to be sure that this is their original work and not copied, reproduced, or stolen. Anything that is not of their own work will require written permission from the original owner to be submitted to MisBEEhaven Designs.   All work done by MisBEEhaven Designs will be that of our own, or of that provided by our client.  The client is held solely responsible for anything submitted to MisBEEhaven Designs.

Confidentiality
MisBEEhaven Designs will not disclose any information that you provide us for the design work on your website.  We will not share or submit any of your information to any third party, unless requested or given permission by the owner of the website, which must be done in a written form of authorization. 

Liabilities
MisBEEhaven Designs is in no way affiliated in any of the businesses we have created websites for.  Any lawsuits, liability, or claims against a company that we have designed for will hold MisBEEhaven Designs harmless in all events should any legal issues arise.

Once you have allowed MisBEEhaven Designs create your website you are also acknowledging that you have read and agreed to the above Terms of Service. 

Consignments
As a service, MisBEEHaven Designs will list your website, webtemplate or domain on our site under Domains For Sale, Web Templates For Sale or Websites For Sale.  You, the owner, agree to the consigner fee of 17% of total price for domain names, 20% of total price of webtemplates, and 25% of total price for websites.  MisBEEHaven Designs will charge the customer the total price minus consigner fees then issue the Owner the remaining balance via Paypal. Owner must have a Verified Paypal Account.  Owner is responsible for all domain transfers and website files /folders transfer.  MisBEEHaven Designs is not responsible for this transfer. If the Owner and Buyer decide not fulfill their purchase, MisBEEHaven retains the right to consigner fees with no refund and is not held responsible for the purchase.
